Dispute Resolution

  • Step 1
  • The complainant and appropriate representative of the other party discuss the dispute
  • if no resolution ↓
  • Step 2
  • The complainant notifies the Code Secretariat of the dispute
  • The complainant and the Managing Director (or equivalent officer of the other party) discuss the dispute
  • if no resolution ↓
  • Step 3
  • The complainant may request that
    • the Code Secretariat; or
    • the complainant’s industry association
  • discuss the dispute with the Managing Director (or equivalent officer of the other party)
  • if no resolution ↓
  • Step 4
  • The complainant takes no further action or continues discussions with the other party or refers the dispute to conciliation
  • Note: The complainant may refer the dispute to conciliation at any time.

Conciliation is the process in which an impartial, neutral, third party (the Conciliator) seeks to assist the parties to a dispute to reach an agreement on a mutually accepted solution.

With the Conciliator’s assistance, the parties identify the issues in dispute, develop options, consider alternatives and endeavour to reach an agreement. In the event that agreement is not reached at conciliation the Conciliator may make a recommendation.

The Conciliator has an advisory role on the content of the dispute and/or the outcome of its resolution, but not a determinative one. The Conciliator reports to the Film Code Committee on the number of disputes that go to conciliation, the number of conciliations that reach settlement and on whether any recommendations were made and followed.

The issues raised during conciliation will not be disclosed to the Film Code Committee as they are confidential to the process.
